Terms of Service for web design, content creation, hosting, and domain services provided by Obizma.

1. Introduction

Welcome to OBIZMA.COM (“Service”). Obizma is a collaborative team providing web design, content creation, hosting, and domain services (“we”, “us”). By engaging our services, you (“Client”, “you”) agree to these Terms of Service (“Terms”).

2. Services Provided

  • Professional web design and development
  • Creation of original website content
  • Design and content modifications upon request
  • Web hosting services
  • Domain name parking and management
  • Hosting and domain renewal validation with reminders

3. Client Responsibilities

  • Provide accurate and complete information
  • Review and approve delivered design and content
  • Maintain accuracy of published website information
  • Comply with all applicable laws and regulations
  • Pay hosting and domain fees on time

4. Service Limitations

  • We are not affiliated with your business activities
  • We do not monitor or update content after approval
  • We are not responsible for errors or outdated content
  • We are not liable for service interruptions due to non-payment

5. Modifications and Revisions

  • Changes are made upon written request
  • Fees apply for additional revisions based on hourly rates
  • Rates are defined in the original service agreement

6. Hosting and Domain Services

  • We provide hosting and domain parking
  • Renewal reminders are sent as a courtesy
  • You are fully responsible for timely payments

7. Content Ownership & Intellectual Property

  • You retain non-exclusive ownership of provided and created content
  • You receive a perpetual, non-exclusive license to use the website
  • We may display work in our portfolio unless agreed otherwise

8. Payment Terms

  • Fees are defined in the service agreement
  • Deposits may be required before work begins
  • Late payments may incur additional charges
  • Renewal fees must be paid promptly

9. Cancellation & Termination

  • Either party may terminate with written notice
  • Services stop at 11:59 PM on the due date if unpaid
  • Reinstatement fee: $24.99
  • Files retained for 30 days after cancellation
  • File transfer fee: $69.99 plus applicable costs

10. Limitation of Liability

  • Services are provided “as-is”
  • No liability for indirect or consequential damages
  • Total liability is limited to fees paid

11. Indemnification

You agree to indemnify and hold Obizma harmless from any claims arising from your website, content, or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the United States and the State of California. Any disputes shall be resolved in California state courts.

13. Amendments

We may update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
